Privateer was formed in English around 1660 from 'private' plus the agent suffix '-eer' (from French -ier). A privateer was a private person authorized by a government to make war at sea. The authorization came in the form of a 'letter of marque and reprisal' — a document that turned piracy into legitimate warfare. Without the letter, the same actions were hanging offenses. With it, they were patriotic service.
The golden age of privateering ran from about 1550 to 1856. English privateers — Francis Drake, John Hawkins, Henry Morgan — attacked Spanish ships in the Caribbean, keeping a share of the plunder and paying the rest to the Crown. Drake's circumnavigation of the globe (1577–1580) was essentially a privateering raid on Spanish Pacific ports. Elizabeth I knighted him for it. Spain called him a pirate. The distinction was a piece of paper.
The American Revolution depended on privateers. The Continental Navy had fewer than 100 ships. American privateers numbered over 1,700 and captured or destroyed about 600 British vessels. The Constitution of the United States explicitly grants Congress the power to issue letters of marque — Article I, Section 8. The founders assumed privateering would remain a tool of American military strategy.
The Declaration of Paris in 1856 abolished privateering among signatory nations. The United States, notably, did not sign — the government wanted to keep the option open. The last privateer commission was never formally revoked. The word privateer faded from military use but survives in business and technology: a privateer in tech is a company that acquires patents specifically to sue other companies for infringement. The permission slip changed, but the business model did not.

Today
Patent trolls are sometimes called privateers. Companies acquire patents they have no intention of using and then sue operating companies for infringement, splitting the proceeds with the patent's original owner. The structure is identical to eighteenth-century privateering: a private entity attacks commerce for profit, with legal authorization.
The permission slip is now a patent portfolio. The letter of marque is a licensing agreement. The target is a tech company instead of a Spanish galleon. Drake would recognize the business model immediately. He just would not recognize the ship.
